Terms & Conditions

§1 Scope

These Terms & Conditions apply to the use of software, SaaS products, and digital platforms of BetStup UG (haftungsbeschränkt) (hereinafter "BetStup").

Depending on the product, these provisions may apply to businesses, consumers, or both. The respective product description, checkout flow, in-app notices, and any product-specific supplementary terms also apply and prevail where more specific.

§2 Service Scope

BetStup provides software solutions in the form of web apps, mobile applications, or platforms.

The specific feature scope is determined by the respective product description.

§3 Usage

Usage is exclusively intended for the respective registered user.

Sharing access credentials or multiple usage is prohibited.

§4 Availability and Uptime

BetStup guarantees availability (uptime) of at least 99.5% per calendar year, measured during business hours (Monday to Friday, 09:00–17:00 CET).

Scheduled maintenance and force majeure events are excluded from this guarantee.

Downtime is documented upon request and may, in case of repeated violations, result in a credit.

§5 Payment Terms

Usage can be billed one-time, monthly, or annually. Exact payment terms are determined by the respective offer.

Accepted payment methods are: credit card, bank transfer, and automatic billing via SEPA direct debit. Payments are processed by certified payment service providers.

For monthly subscriptions, billing occurs on the same day each month. Annual subscriptions are billed once per year.

BetStup reserves the right to adjust prices with 30 days' notice. Customers will be notified of price changes by email.

In case of payment defaults, statutory default interest may be charged.

For consumers, the final prices displayed in the relevant checkout flow, including statutory taxes and other price components, apply.

§6 Term and Cancellation

Unless otherwise agreed, monthly subscriptions can be cancelled at any time with 7 days' notice to the end of a billing period. Annual subscriptions can be cancelled with 30 days' notice to the end of the contract year.

Cancellation must be made in writing or through the customer account.

Refunds for already paid amounts are not made, unless a free trial period or satisfaction guarantee was agreed upon.

BetStup reserves the right to block access to the service after subscription termination.

Statutory withdrawal rights of consumers and product-specific cancellation or renewal rules shown during checkout or in the user account remain unaffected and take precedence over these general provisions to that extent.

§7 Rights of Use

The customer receives a simple, non-transferable right of use to the software.

The source code remains entirely with BetStup.

§8 Liability

BetStup is liable only for intent and gross negligence.

Liability for data loss, system failures, or lost profits is excluded.

The above limitations of liability do not apply in cases of injury to life, body, or health, claims under product liability law, expressly assumed guarantees, or wherever liability is mandatory by law.

§9 Software Changes

BetStup is entitled to adjust, further develop, or limit functions, provided this is reasonable for the customer.

Material feature restrictions will be communicated to the customer at least 14 days in advance by email.

If a change significantly impairs usability, the customer has the right to cancel their subscription without penalties.

§10 Blocking and Account Security

In case of violations of these Terms & Conditions – in particular unauthorized use, abuse, or breach of usage terms – BetStup is entitled to temporarily block access.

The customer will be notified by email before blocking and has 7 days to remedy the violation.

In case of serious violations or repeated violations, blocking may be immediate and permanent.

The customer is responsible for the security of their access credentials and must change passwords regularly.

§11 Data Protection and Data Security

BetStup handles all customer data in accordance with the General Data Protection Regulation (GDPR) and German data protection law.

Customer data is stored on secure servers with encryption and used only for service delivery. For detailed information about data processing and data processors used, please see our Privacy Policy.

After subscription termination, customer data will be deleted within 90 days, unless a statutory retention obligation applies.

Daily automated backups are performed; however, complete data backup for recovery purposes is not guaranteed.

§12 Usage Limits and Resource Quotas

Depending on the subscription tier, limits may apply to: API calls per minute/day, storage space, number of users, or number of projects.

These limits are visible to the customer at registration and in the customer account.

Exceeding these limits may result in throttling, blocking, or additional fees. The customer will be notified when limits are critical.

§13 Beta Features

BetStup may provide certain features as beta, preview, or experimental versions.

Such features may be changed or removed without notice. Liability for errors or data loss in beta features is excluded.

§14 Force Majeure

BetStup is not liable for downtime or service failures caused by force majeure events, such as natural disasters, war, pandemics, power outages, or internet interruptions by third parties.

§15 Jurisdiction and Law

German law applies.

For entrepreneurs, legal entities under public law, or special funds under public law, the place of jurisdiction is the registered office of BetStup. For consumers, the statutory rules on jurisdiction apply.
